Fiscal Year # 2010

Because of year end of 1/03/10 resulted in a Fiscal Year of 2010. To may it Fiscal Year 2009 do I have to edit the Year end date in GL 8 to 12/31/09 and redo the conversion?

Yup. You got it.
The fiscal year identifier is taken from the year of the closing date at the time the year is created. This would be either during conversion from GL8x, or running the Create Next Fiscal Year (Budget) with version 90A or 90B.
